1. Agreement to Terms

By accessing or using VelvetVault ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including photographers and their clients who view galleries.

2. Description of Service

VelvetVault is a private gallery delivery platform for professional photographers delivering client work to adult clients. The Service allows photographers to upload, organize, and share photography with their clients through secure, access-controlled galleries. Galleries are invitation-only, not publicly discoverable, and designed for professional, consensual photography sessions between adults.

3. Account Registration

To use the Service, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized account access

4. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

• Upload content depicting minors in any context
• Upload content without proper consent from all individuals depicted
• Use the Service for any illegal purpose or to violate any laws
• Upload content that promotes violence, harassment, or discrimination
• Attempt to gain unauthorized access to other accounts or systems
• Interfere with or disrupt the Service or its infrastructure
• Resell or redistribute the Service without authorization

5. Photographer Responsibility

By uploading content, you represent and warrant that:

• All subjects depicted are at least 18 years of age
• All content is consensual and legally obtained
• You have the legal right to upload and distribute the content
• The content complies with all applicable laws and regulations
• You have obtained appropriate model releases and consents for all individuals depicted

VelvetVault does not produce, curate, or commission content and functions solely as a neutral platform for private content delivery.

6. Content Policy

VelvetVault supports private delivery of professional photography involving adult clients, including artistic portraiture and boudoir photography in its traditional, non-explicit form.

VelvetVault does not permit:

• Pornographic content
• Explicit sexual acts
• Fetish content
• BDSM or sexualized violence
• Simulated sex acts
• Content depicting coercion, abuse, or exploitation
• Any depiction involving minors

We reserve the right to remove any content that violates these guidelines at our sole discretion. For complete details, please review our Content Guidelines.

7. Takedown Policy

VelvetVault honors takedown requests from individuals depicted in uploaded content. Upon verified request, content will be removed promptly regardless of prior consent.

To submit a takedown request, please contact us at kyle@kyletyndallfilms.com with verification of your identity and the specific content to be removed.

8. Content Safety & Moderation

To maintain a safe and lawful platform for all users, VelvetVault employs content monitoring practices to detect and prevent the upload of illegal imagery, including but not limited to child sexual abuse material (CSAM) and non-consensual intimate content.

VelvetVault reserves the right to remove content that violates platform policies or applicable laws. Content moderation may occur via automated systems, user reports, or manual review.

Reporting Obligations: In accordance with federal law, we will report any discovered illegal content to the National Center for Missing & Exploited Children (NCMEC) and appropriate law enforcement agencies.

Zero Tolerance: Accounts found to contain illegal imagery will be immediately terminated, and all relevant information will be preserved and provided to law enforcement authorities.

9. Subscription and Payment

Founders Pricing: Early adopters who sign up during our founding period receive special pricing that remains locked in for the lifetime of their account, as long as the subscription remains active.

Billing: Subscription fees are billed according to your plan terms. You may cancel your subscription at any time, though founders pricing cannot be reinstated once cancelled.

Refunds: Contact us within 7 days of payment for refund requests.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may suspend or terminate the Service for maintenance, updates, or other reasons with or without notice. We are not liable for any loss or damage resulting from service interruptions.

11. Limitation of Liability

To the maximum extent permitted by law, VelvetVault shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless VelvetVault and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your content, or your violation of these Terms.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for any violation of these Terms. Upon termination:

• Your right to use the Service will cease immediately
• We may delete your content within 30 days
• Provisions that by their nature should survive termination will survive

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.
